Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the Parlat application (the "App"), operated by DKPEAK. By creating an account, signing in or using the App you agree to these Terms. If you do not agree, do not use the App. These Terms also serve as the end user licence agreement (EULA) for the App.

1. Parties, Definitions and Scope

These Terms are entered into between DKPEAK ("we") and the person using the App (the "User" or "you").

"Employer" means a user looking for services for a home or workplace; "Worker" means a user offering to provide those services. A single user may hold both profiles at the same time.

The App is a marketplace platform that helps Employers and Workers find each other for services such as house cleaning, ironing, window cleaning, cooking, babysitting, office cleaning, and carpet and curtain washing.

These Terms apply to every screen, feature and piece of content in the App and to all services offered through it.

2. The Platform's Role and Its Limits

The App is only an intermediary platform. We do not provide cleaning or any similar service ourselves, we do not employ Workers, and we are not the representative, agent or proxy of any Employer or Worker.

DKPEAK is not a private employment agency and does not carry out job placement or employment brokerage activities. Any relationship formed between users is strictly between those users.

Performance of the work, the fee, working hours, working conditions, occupational health and safety, insurance, taxes and any dispute arising between users are the users' own responsibility.

We do not verify users' statements and we do not run criminal record or reference checks. The approval process we apply to Worker profiles (see section 6) is a basic content review, not a guarantee of safety or competence.

We do not guarantee any user's identity, trustworthiness or competence, the quality of the work performed, or that users will act lawfully. Exercising due care before agreeing with the other party is your responsibility.

3. Eligibility and Account Creation

You must be at least 18 years old and have the legal capacity to enter into a binding contract in order to use the App. If you are under 18 you may not use the App.

An account is created by signing in with your Google, Apple or Facebook account. You do not set a separate password; the security of your account depends on the security of the Google/Apple/Facebook account you sign in with.

You agree that the information you provide is accurate and current and that you will keep it up to date. Providing false or misleading information is a breach of these Terms.

4. Account Security and One Account per Person

Your account is personal. It may not be transferred, sold or made available for someone else's use. One person may open only one account.

You are responsible for every action taken through your account and for all content shared from it.

If you suspect unauthorised access, account takeover or any security breach, notify us immediately at [email protected]. You can end your sessions on all devices from within the App.

5. User Obligations

Employers must accurately state the description, location, timing and requirements of the work and the conditions of the home or workplace, treat Workers respectfully and lawfully, provide a safe working environment, and pay the agreed fee on time.

Workers must accurately present their skills, experience and availability, perform the work as agreed in a safe, respectful and professional manner, and comply with occupational health and safety rules.

Users are solely responsible for complying with all legislation applicable to them, including employment, tax, social security, insurance and occupational health and safety rules.

You are responsible for the address, phone number and similar information you share with the other party. Take care of your personal safety when meeting and working.

6. Worker Profile Approval

A newly created Worker profile is first placed in a "pending approval" state and is not visible to other users until it has been reviewed.

With a pending or rejected Worker profile you cannot apply to listings, publish Worker listings or purchase visibility packages.

If your profile is rejected you will be told why. Editing and saving your profile submits it for review again.

The review decision is made by a person, not by a fully automated system.

7. Listings and Applications

Listings and applications are created by users; their content, accuracy, currency and lawfulness are the responsibility of the user who created them.

Publishing a listing and applying to a listing may require spending credits. Current amounts are shown on the relevant screen before the transaction.

Listings have a limited publication period; expired listings are automatically removed from the feed.

Where we suspect a safety issue, fraud or abuse, we may suspend, remove or restrict access to a listing without prior notice. Credits spent may not be refunded in that case.

8. Messaging and Communication

In-app messaging allows text messages only. You are responsible for the content of your messages and for the information you share while communicating.

Messages are not end-to-end encrypted. Our authorised personnel may access message content for the purposes of investigating rule violations, combating abuse and fraud, and responding to legal requests.

Blocking a user ends messaging between you both. If you see a rule violation you can report the user.

Do not share sensitive personal information (identity numbers, bank details and the like) through messaging unless it is genuinely necessary.

9. Payment for Services

The fee for work between users is paid outside the App, directly between the users. The App provides no money transfer or collection infrastructure between users and is in no way a party to those payments.

DKPEAK is not responsible for unpaid fees, partial or late payments, payment disputes or collection.

This section does not cover credits purchased inside the App; credits are governed by section 10.

10. Credits and In-App Purchases

Some features of the App are used with credits. Credits are spent on actions such as publishing a listing, applying to a listing and purchasing Worker visibility packages. Bonus credits may be granted in cases such as signing up or leaving a review. Current amounts are shown on the relevant screens.

Credits are not money. They cannot be transferred to another account and, unless applicable law requires otherwise, they cannot be converted into cash or refunded. Credit packages are one-off and do not renew automatically.

Credit purchases are made through the Apple App Store or Google Play. The payment is carried out by the relevant store; we have no access to your card or billing information. Purchases are subject to that store's terms and refund policy, and refund requests must be directed to Apple or Google.

Credits are digital content and are added to your account immediately at the moment of purchase. In accordance with article 15 of the Turkish Distance Contracts Regulation, you acknowledge that there is no right of withdrawal for digital content that is performed immediately.

You can restore earlier purchases using the "Restore purchases" option on the Credit Wallet screen.

If your account is closed because you breached these Terms, your unused credits are not refunded.

11. User Content

You may share listings, photos, messages, reviews, application notes and similar content ("User Content"). You retain ownership of your User Content.

For the limited purpose of operating the App, you grant DKPEAK a worldwide, non-exclusive, royalty-free and sublicensable licence to host, store, reproduce, adapt and display your User Content to the relevant users within the App. This licence ends when you remove the content or your account is deleted, although it may continue for a reasonable period for content held in technical backups and in the other party's records.

You must hold all necessary rights to the content you upload. Do not upload third parties' photos, personal data or copyrighted material without permission. When sharing photos of your home, take care that other people do not appear in them.

Profile and listing photos you upload are stored in a way that anyone who knows the link can access. For that reason, make sure your photos do not contain sensitive information such as address signs, identity documents or licence plates.

We may remove User Content or restrict access to it in order to comply with legislation and platform rules.

12. Reviews

After a completed job you may leave a rating and a comment for the other party. Reviews must be honest, based on your own experience, relevant and respectful.

Reviews are visible to other users on the reviewed user's profile, together with your name and profile photo.

Reviews given in exchange for any benefit, reviews intended to intimidate the other party, and untruthful reviews are prohibited.

DKPEAK does not guarantee the accuracy of reviews and is not responsible for user opinions. We may remove reviews that breach our rules or the law.

13. Prohibited Conduct and Zero Tolerance for Objectionable Content

We operate a zero-tolerance policy for objectionable content and abusive behaviour. The following are prohibited and may result in your account being closed:

Harassment, threats, insults, hate speech, discrimination, incitement to violence, sharing sexual or obscene content, or continuing to contact a user who does not want it.

Posting misleading listings, creating fake profiles, impersonating someone else, writing fake reviews, attempting fraud, or deceiving users by directing them to pay outside the App.

Using the App for any unlawful purpose, including the commission of any offence such as human trafficking, child abuse or forced labour.

Attempting to weaken the App's security, exceed usage limits, scrape data with automated tools, reverse engineer the App, upload malware or gain unauthorised access to our systems.

Using the App for advertising, spam, chain messages or promotions unrelated to the platform's purpose.

14. Reporting, Complaints and Moderation

You can block or report a user from their profile. You can select a reason for the report and add a description.

We review reports that reach us within 24 hours at the latest. Where we find a rule violation we remove the content and, where we consider it necessary, suspend or close the account concerned.

In urgent and serious situations (violence, harassment, suspected crime) contact us directly at [email protected] and, where appropriate, contact law enforcement.

Making bad-faith or baseless reports is itself a breach of these Terms.

15. Suspension, Ban and Appeal

If we reasonably consider that you have breached these Terms, that you pose a risk to other users or that you have acted unlawfully, we may suspend or close your account.

When your account is closed all your sessions are ended immediately and your access to the App is blocked. The reason is shown to you inside the App.

If you believe the decision is wrong you may appeal at [email protected]; we will assess your appeal within a reasonable time and inform you of the outcome.

On termination your right to use the App ends, although provisions that by their nature must survive remain in force.

16. Deleting Your Account and the 30-Day Restore Window

You can delete your account at any time using the "Delete account" option on the Profile screen.

Your deletion request takes effect immediately: your profile and listings become invisible to other users and all your sessions are ended.

Within 30 days of your request you can restore your account by signing in again with the same Google/Apple/Facebook account. If you restore it within that period your account is reopened as it was, and any visibility package still running at the time of the deletion request is extended by the time that elapsed.

At the end of the 30 days your account is permanently anonymised and cannot be restored. Which data is erased at that point, and which data is retained and why, is explained in the "Retention Periods" section of the Privacy Policy and KVKK Notice.

If you sign in with the same Google/Apple/Facebook account after anonymisation, a brand-new account is created and you cannot access the content of your old account.

17. Service Changes, Maintenance and Forced Updates

We may change, add or remove features of the App. We will try to announce significant changes inside the App.

The App may be temporarily closed to use during maintenance work. You will be informed inside the App if that happens.

For security and compatibility reasons we may block the use of app versions below a given version and require you to update.

18. Intellectual Property

The software, design, interface, trade marks, logos and all other elements of the App belong to DKPEAK or its licensors.

These Terms grant you a limited, non-exclusive, non-transferable and revocable right to use the App for personal, non-commercial purposes; they transfer no ownership rights.

19. Disclaimer of Warranties

The App is provided "as is" and "as available". DKPEAK does not guarantee that the App will be uninterrupted, error-free or completely secure.

To the extent permitted by law, all express or implied warranties are disclaimed, including merchantability, fitness for a particular purpose and non-infringement.

This section does not remove your statutory rights under consumer legislation.

20. Limitation of Liability

To the maximum extent permitted by law, DKPEAK is not liable for indirect, incidental, special or consequential damages, or for loss of profit, data or reputation, arising from your use of the App, from the relationship between users, or from any user's conduct.

In any event, DKPEAK's total liability is limited to the total amount you paid us under the App in the 12 months before the event giving rise to the loss.

These limitations do not apply in cases of intent or gross negligence, in cases where liability cannot be limited by law, or where consumers' mandatory rights are concerned.

21. Indemnity

You agree to indemnify DKPEAK against any claim, damage, penalty and reasonable legal costs arising from your use of the App, your User Content, or your breach of these Terms or of the law.

22. Protection of Personal Data

The purposes for which your personal data is processed, who it is shared with, how long it is retained and what your rights are, are explained in detail in the Privacy Policy and KVKK Notice inside the App. That document forms an integral part of these Terms.

23. Changes, Governing Law, Jurisdiction and Language

We may update these Terms from time to time. When we do, we change the "Last updated" date and the version number, and for significant changes we also notify you inside the App. Continuing to use the App after a change means you accept the updated Terms.

These Terms are governed by the laws of the Republic of Türkiye.

The courts and enforcement offices of Istanbul have jurisdiction over disputes. For users who are consumers, this provision does not remove the right to apply to the Consumer Arbitration Committees and Consumer Courts at the consumer's place of residence.

The Turkish text of these Terms prevails. The English text is provided for information only; in case of conflict the Turkish text applies.
